CHAPTER 398.


AN ACT to repeal section one hundred and sixty-four, of article


twenty-two, of the Code of Public Local Laws, entitled " Wash-


ington county," sub-title "Hagerstown," and to re-enact the


same with amendments.


SECTION 1. Be it enacted by the General Assembly of Maryland,

That section one hundred and sixty-four, be and the same is here-


by repealed and re-enacted, so as to read as follows :


SEC. 164. At the first regular meeting after each annual elec-


tion, and after the qualification of the newly elected members, or


as soon thereafter as may be convenient, the mayor, with the ad-


vice and consent of the council, shall appoint one person as clerk,


one person as collector of taxes, one person as market inspector,


and one of the justices of the peace of said town to act as police


justice, and such other officers as may be provided for the conduct


and regulation of municipal affairs, except such officers as are

hereinafter provided for; and in case of any vacancy or removal of

any officer so appointed, the mayor shall fill such vacancy for the


unexpired term, with the advice and consent of the council, aa


hereinbefore provided; either of the above named officers shall be


subject to removal by a vote of four-fifths of the whole council, or


a vote of three councilmen, with the approval of the mayor; and


in case of sickness or temporary absence of the police justice, so


appointed under this section, the mayor shall have the power to


designate some one of the justices of the peace of " Washington


county" to temporarily act as police justice until the regularly ap-
pointed police justice is able to assume the duties of his office.

CHAPTER 399.

AN ACT to add an additional section to article twenty-seven, of
the Code of Public General Laws, title " Crimes and Punish-
ments," and to be entitled "Fraud, Breach of Trust," to be


numbered eighty-seven A, and to follow section eighty-seven of


the said article.


SECTION 1. Be it enacted by the General Assembly of Maryland,
