ture of liquors which shall contain more than two per cent, by
|
|
|
|
weight of alcohol, and every mixture of liquors which shall con-
|
|
|
|
tain less than two per cent, of alcohol, if the same shall be intoxi-
|
|
|
|
cating; nothing in this act shall be construed to authorize the
|
|
|
|
sale of any intoxicating liquors or any admixture thereof, in any
|
|
|
|
part of said city where such sale now is, or shall hereafter be pro-
|
|
|
|
hibited by special law.
|
|
|
|
653 B. The governor shall, on or before the tenth day of April,
|
|
|
|
in the year eighteen hundred and ninety, appoint three persons,
|
|
|
|
not more than two of whom shall belong to the same political
|
|
|
|
party, who shall constitute a board of liquor license commis-
|

|
sioners for Baltimore city, who shall hold their office for the
|
|
|
|
period of two years, and whose successors shall be appointed by
the governor biennially, by and with the advice and consent of
|
|
|
|
the Senate, their duties shall be such as are hereinafter prescribed.
|
|
|
|
653 C. The said board shall appoint such clerk or clerks as
|
|
|
|
the proper transaction of the business of the board shall require;
|
|
|
|
and shall keep a full record of all applications for license, of all
|
|
|
|
recommendations for, and remonstrances against the granting of
|
|
|
|
licenses, and of their action thereon; and the vote of the members
|

|
of said board, by yeas and nays, shall be taken on the question
|
|
|
|
of granting or refusing every application for license, and said
|
|
|
|
records of said board shall, at all suitable times, be open to the
|
|
|
|
inspection of the public; all necessary books and stationery shall
|
|
|
|
be furnished by the mayor and city council of Baltimore, and
|
|
|
|
all salaries and expenses necessarily incident to the business of
|
|
|
|
the board shall be paid by said mayor and city council.
|
|
|
|
653 D. The said board shall fix the salaries of all clerks ap-
|
|
|
|
pointed by them for the performance of the duties imposed by
|
|
|
|
this act, and the members of said board shall each receive a
|

salary of fifteen hundred dollars, to be paid as the salaries of offi-

|
cers of the city of Baltimore are paid.

|
|
|
653 E. No licenses to sell intoxicating liquors other than by
|
|
|
|
wholesale traders, distillers, brewers and rectifiers, shall be granted
|

|
in the city of Baltimore except by said board, and only to citizens
|
|
|
|
of the United States of temperate habits and good moral char-
|
|
|
|
acter, who have complied with the requisites of this act.
|
|
|
|
653 F. No license shall be issued for a longer period than one
|
|
|
|
year; if issued for a shorter period the licensee shall pay for every
|
|
|
|
month for which his license is to run one-twelfth of the annual
|

|
charge for such license, and all such licenses shall expire on the
|
|
|
|
first day of May succeeding their issue, on which day all licenses
|
|
|
|
issued by the said board shall expire.
|
|
|
|
653 G. Every person applying for a license to sell intoxicating
|
|
|
|
liquors in said city shall file with the said board his, her, or their
|
