CHAPTER 322.


AN ACT to repeal and re-enact with amendments section three-


hundred and sixty-eight, of article eleven, of the Code of Pub-


lic Local Laws of Maryland, title "Frederick county," sub-title


"Middletown," and to add to said article the following sections


to be designated "section three hundred and seventy-three A,


section three hundred and seventy-three B, section three hun-


dred and seventy-three C and section three hundred and seventy-


three D.


SECTION 1. Be it enacted ly the General Assembly of Maryland,


That section three hundred and sixty-eight, of article eleven, of

the Maryland Code of Public Local Laws, entitled "Frederick


county," sub-title "Middletown," be repealed and re-enacted so


as to read as follows, and that the following additional sections


be added to said article of said Local Code to be known as "sec-


tions three hundred and seventy-three A, and three hundred and


seventy-three B, and three hundred and seventy-three C, and


three hundred and seventy-three D."


SEC. 368. All fines, forfeitures and penalties under the ordi-


nances of the corporation shall be recoverable before the burgess,


or any one of said commissioners, or before any justice of the

peace for Frederick county, in the same manner as small debts,


and any person refusing to pay such fines or forfeitures shall be


committed to the jail of Frederick county until payment or dis-


charged in due course of law, and each of- said commissioners


shall in virtue of his office have and exercise all the powers of a


justice of the peace in so far as the recovery of said fines and


forfeitures are concerned, and may commit to jail for the non-


payment thereof.


SEC. 373 A. The burgess and commissioners of Middletown

Lock-up,

shall have power to build a lock-up to be used for lawful pur-


poses, the cost of which shall not exceed one hundred and fifty


dollars, and 'to levy the necessary taxes therefor.


SEC. 373 B. The burgess and commissioners of Middleton shall

have power to prevent by ordinance and effectually prohibit hors

cattle and all other animals from running at large upon the streets,


lanes, alleys and other public places within the corporate limits


of Middletown.


SEC. 373 C. The burgess and commissioners of Middletown;


shall have full power and authority to authorize and permit and

by ordinance to grant to any railroad company whose road enters


or intended to enter the limits of the corporation of Middletown,


the right and privilege of laying down and constructing its track


and of building and grading its road along, through and over
