LAWS OF MAKYLAND.


SEC. 31 A. That the county commissioners of Garrett county ,


shall levy annually for the crier of the circuit court for said

county, two dollars and fifty cents per day for his services as such


crier, and the treasurer for said county shall pay said crier at the


close of each session of the court for his services during said ses-


sion.

Repeal

SEC. 2. And be it enacted, That section eighteen, of article thirty-
six, of the Code of Public General Laws of Maryland, title "Pees
of Officers," sub-title " Criers," be, so far as the same relates to


Garrett county, and all other acts or parts of acts inconsistent


with this act be and the same are hereby repealed.

Effective.

SEC. 3. And be it enacted, That this act shall take effect from


the date of its passage.

CHAPTER 193.


AN ACT to reimburse moneys erroneously paid into the State


treasury on account of marriage licenses issued under chapter


four hundred and ninety-seven, of the acts of assembly eighteen


hundred and eighty-six, by the clerks of the circuit courts of


this State.


WHEREAS, by a decision of the court of appeals of Maryland,


in the case of the State versus Davis, vide seventy Maryland reports,

page two hundred and thirty-seven, it was determined that all


moneys under chapter four hundred and ninety-seven, of the acts


of eighteen hundred and eighty-six, were legally retainable by the


clerks of the court issuing the same; and,


WHEREAS, under a misinterpretation of said law, and until the

above case was decided, the clerks of courts herein mentioned did


pay into the State treasury the various amounts hereinbelow as-


certained; therefore,


SECTION 1. Be it enacted ty the General Assembly of Maryland,


That the comptroller of the treasury is hereby authorized and di-


rected to draw his warrant upon the State treasurer in favor of the


following parties for amounts as follows : to Theodore Luman, clerk


circuit court for Allegany county, two hundred and eighty-one

dollars and twenty-three cents; to Sprigg Harwood, clerk circuit


court for Anne Arundel county, two hundred and thirty-one dol-


lars and thirty-four cents; to John Sedwick, clerk circuit court


for Calvert county, eighty dollars and seventy-three cents; to


Luther H. Gadd, clerk circuit court for Caroline county, one


hundred and forty-seven dollars and seventy-five cents; to J.


Samuel Turner, clerk circuit court for Charles county, eighty
