clerks shall receive the compensation as decided upon by the

|
|
mayor and council of said town, to be paid for by said town.
|
|
|
|
SEC. 8. And be it enacted, That in case of death, refusal to act,
|
|
|
|
resignation or disqualification of the mayor or any of the coun-
|
|
|
|
cilmen, the councilmen, or the remaining councilmen shall direct
|

an election to be held to fill such vacancies; and the mayor and
|
|
|
|
councilmen, or remaining councilmen, shall give at least ten days'
|
|
|
|
notice of all elections in one or more newspapers published in
|
|
|
|
said town or county.
|
|
|
|
SEC. 9. And be it enacted, That the mayor shall ex-officio have
|
|
|
|
all the power of a justice of the peace in cases where the town is
|
|
|
|
a party, and an appeal may be taken from his judgment to the
|

|
circuit court for Allegany county in the same manner as from a
|
|
|
|
judgment of a justice of the peace of said county.
|
|
|
|
SEC. 10. And be it enacted, That the mayor and councilmen
|
|
|
|
shall meet at the council chamber on the fourth Tuesday of April
|
|
|
|
next succeeding their election, and the said councilmen shall be-
|
|
|
|
fore they enter upon the duties of their office make oath before
|

the mayor that they will diligently and faithfully to the best of
|
|
|
|
their judgment perform the duties of said councilmen of said
|
|
|
|
town, without favor, partiality or prejudice; the mayor shall take
|
|
|
|
the oath prescribed by the constitution as directed by section six,
|
|
|
|
of article seventy-eight, of the code.
|
|
|
|
SEC. 11. And beit enacted, That they shall meet at the council
|
|
|
|
chamber, or some other place, at least once in every three months,
|
|
|
|
or oftener if they shall think necessary; and the mayor shall pre-
|

side at all meetings of the council and have the same power of
|
|
|
|
voting and taking part in all acts and deliberations of the coun-
|
|
|
|
cil as any member thereof.
|
|
|
|
SEC. 12. And be it enacted, That the mayor and councilmen
|
|
|
|
shall annually, in the month of April, appoint and qualify a
|
|
|
|
clerk who shall keep the minutes of their proceedings, which
|
|
|
|
shall be subject to the inspection of all persons interested therein;

also a treasurer, who shall give bond and security, and pay moneys
|
|
|
|
only on the order of the mayor and councilmen; also a registra-
|
|
|
|
tion officer who shall register all those qualified to vote at such
|
|
|
|
time and place as the mayor and council may direct.
|
|
|
|
SEC. 13. And be it enacted, That they shall annually, in the
|
|
|
|
month of April, appoint a bailiff and such police force as they
|
|
|
|
may deem necessary for said town, who before entering upon the
|
|
|
|
duties of their office shall make oath before the mayor and coun-
|

cilmen that they will faithfully perform the duties required of
|
|
|
|
them as officers, according to the best of their skill and judgment,
|
|
|
|
without favor, affection or prejudice, and the bailiff shall give
|
|
|
|
bond and security in such sum as the mayor and councilmen may
|
|
|
|
designate.
