or their place of business, any spirituous or fermented
|
|
|
|
|
liquors or intoxicating drinks of any kind, cider and
|
|
|
|
|
home-made wine, the proportion of alcohol in which
|
|
|
|
|
does not exceed fifteen per cent., excepted, in any
|
|
|
|
|
election district of said county wherein a majority
|
|
|
|
|
of the votes has thus been cast against the sale of
|
|
|
|
|
spirituous or fermented liquors, nor shall any license
|
|
|
|
|
be issued or granted for the sale of the same in any
|
|
|
|
|
of said election districts in said county, on or after
|
|
|
|
|
the first day of May, in the year eighteen hundred
|
|
|
|
|
and eighty-one.
|
|
|
|
|
SEC. 3. And be it enacted, That if any person or
|
|
|
|
|
persons, or body corporate, shall sell directly or indi-
|
|
|
|
|
rectly at any place, or give away at his, her or their
|
|
|
|
|
place of business, any fermented or spirituous liquors
|
|
|
|
|
or intoxicating drinks of any kind, cider and home-
|
|
|
|
|
made wine, the proportion of alcohol in which does
|
|
|
|
|
not exceed fifteen per cent., excepted, in any of said
|
|
|
|
|
election districts wherein a majority of the votes has
|
|
|
|
|
been thus cast against the sale of spirituous or fer-
|
|
|
|
|
mented liquors, on or after the first day of May, in
|
|
|
|
|
the year eighteen hundred and eighty-one, he, she
|

or they shall, on conviction thereof in the circuit
|
violation.

|
|
|
court for said county, be fined for the first offence
|
|
|
|
|
not less than fifty dollars nor more than two hundred
|
|
|
|
|
dollars, and for each subsequent offence not less
|
|
|
|
|
than two hundred nor more than three hundred dol-
|
|
|
|
|
lars, and on failure to pay the same shall be com-
|
|
|
|
|
mitted to the jail of said county until such fine and
|
|
|
|
|
the costs are paid, and said fines shall be paid to the
|
|
|
|
|
board of school commissioners of said county for the
|
|
|
|
|
benefit of the public schools in the election district
|
|
|
|
|
wherein the violation of this act occurred.
|
|
|
|
|
SEC. 5. And be it enacted, That nothing herein con-
|
|
|
|
|
tained shall be construed to prevent the compound-
|

ing or sale of any such liquors by a pharmacentist
or druggist who may or shall obtain license therefor
|

|
|
|
|
under the license laws of the State, upon the written
|
|
|
|
|
bona fide prescription of a regular practicing phys-
ician of such district, whose name shall be signed
|
|
|
|
|
thereto ; and every such prescription shall be filed
|
|
|
|
|
and kept by such pharmaceutist or druggist, and no
|
|
|
|
|
prescription shall serve more than one purchaser; but
|
|
|
|
|
no physician shall make or sign any such prescription
|
