public road in Calvert county; and any person vio-
lating; this section shall, on conviction thereof before


a justice of the peace, be adjudged guilty of a mis-


demeanor, and be fined not less than twenty-five nor


more than fifty dollars, which fine shall be collected


as other small debts are, and one half be paid to the


informer and the other half to the county commis-


sioners of said county.


SEC. 3. And be it enacted, That it shall be the


duty of the road supervisors and road contractors to


remove from the public roads in their respective dis-


tricts or sections in said county, all and any gates or


gate which they shall find thereon in violation of

or gates shall, on conviction thereof before a justice


of peace, be adjudged guilty of a misdemeanor, and


be fined not more than twenty nor less than ten dol-


lars, one half thereof to be paid to the informer and

ers of Calvert county.


SEC. 4. In order to ascertain the will of the peo-


ple in regard to the removal of gates from the public


roads of Calvert county, the legal qualified voters


of Calvert county are hereby authorized to cast a


separate ballot at the general election in November,


eighteen hundred and eighty, of which due notice


shall be given, as in the case of other ballots ; and


the tickets so voted shall be on a separate piece of

paper, with the words " for gates," or " against


gates," on the inside ; that ballots so cast shall be


counted and returned by the judges of said election


in the same way and manner as other ballots then


cast shall be. In case a majority of the votes then


cast shall be against gates, then this law shall be in


full force and virtue ; but in case a majority of said


votes in the county shall be for gates, then this law


shall be null and void.
