majority for restricted license as set forth in section

five of this act, may file his petition with the Clerk
|
|
|
|
of the Circuit Court for Somerset county, setting
|
|
|
|
forth therein that he wishes to sell or barter intoxi-
|
|
|
|
cating, spirituous or fermented liquors by the drink
|
|
|
|
only ; and any storekeeper, except apothecaries, in
|
|
|
|
said county, may file his petition as above stated, to
|
|
|
|
sell intoxicating, spirituous or fermented liquors in
|
|
|

quantities not Jess than a pint; provided he shall
|
|
|
|
file with said petition a written certificate signed by
|
|
|
|
twelve freeholders, resident citizens of the school
|
|
|
|
district in which said applicant desires to sell intoxi-
|
|
|
|
cating liquor, setting forth their belief that the
|
|
|
|
applicant for such license will keep an orderly house,
|
|
|
|
and duly observe the provisions of this act ; and if
|
|
|
|
said applicant he a hotel keeper, shall satisfy the
|
|
|
|
said clerk, by his own oath, and by the oath of two
|
|
|
|
respectable and disinterested witnesses, of their be-
|
|
|
|
lief therein, that he has bona fide, and without in-
|
|
|

tending to evade the spirit and meaning of this act,

duly provided, and will maintain and Keep for use
|
|

at least four good beds, with sufficient covering
|
|
|
|
therefor, and at least two chambers more than is or

may be sufficient for the private or family purposes

|
of said hotel keeper, with stabling to be at all times

|

sufficient for four horses at least, all said beds and
|
|
|
|
chambers to be and remain on the same premises on

which intoxicating liquor, is by this act, licensed to

be sold ; and each applicant shall also file in the of-

fice of said clerk his bond, duly executed to the State
|
|
|
|
of Maryland, with at least two sureties, to be ap-
|
|
|
|
proved by sajd clerk, in the penal sum of one thou-
|
|
|
|
sand dollars, conditioned for the faithful observance
|
|
|
|
of the provisions of this act, and the payment of any
|
|
|
|
and all fines, penalties and damages which may be
|
|
|
|
imposed and recovered under this act, which said
|
|
|
|
bond shall be responsible to all such persons herein-
|
|
|
|
after described as may be injured by the sale of in-
|
|
|
|
toxicating liquors sold by any person licensed under
|
|
|

this act ; provided, however, that if there shall not
|
|
|
|
be twelve freeholders resident in the school district
|
|
|
|
in which the house may be situated, where intoxi-
|
|
|
|
cating liquor is expected to be sold, or if said house
|
|
|
|
be not situated within the limits of any school dis-
|
|
|
|
trict, in such case it shall be sufficient that the cer-
|
|
|
|
tificate required by this section shall be signed by
