Anne Arundel county, and the county commissioners

missioners re-
quired to levy

are hereby authorized and required to levy such sum
as may be necessary to pay the said register of wills
|
|
|
|
the expenses of making said copies and indexes,
|
|
|
|
which said expenses shall be at the rate now allowed
|
|
|
|
by law for such services to register of wills and the
|
|
|
|
costs of the docket books in which said copies and
|
|
|
|
indexes may be made.
|
|
|
Effective.
|
SEC. 3. And be it enacted, That this act shall take
|
|
|
|
effect from the date of its passage.
|
|

AN ACT to repeal section twenty-five of article
|
|
|
|
seventy-five of Code Public Laws, title "Pleadings,
|
|
|
|
Practice and Process," sub- title " Practice," and

|
|
|
re-enact the same with amendments.
|
|
|
|
SECTION 1. Be it enacted ty the General Assem-
|
|
|
|
bly of Maryland, That section twenty-five of article
|
|
|
Repealed and
|
seventy-five of the Code of Public General Laws,
|
|
|
re-enacted.

" Practice," be and the same is hereby repealed and
re-enacted with amendments so as to read as follows:

|
|
No action

SEC. 25. No writ or action shall abate because of
|
|
|
shall state
|
the misnomer of any plaintiff or defendant named
|
|
|
|
therein, but the court, on suggestion, supported by
|
|
|
|
the affidavit of the plaintiff or defendant, or other
|
|
|
|
proof to the satisfaction of the court, that by mis
|
|
|
|
take the plaintiff has sued in a wrong name, or that
|
|
|
|
the party summoned in virtue of said writ or action
|
|
|
|
is, in fact, the party intended to be sued by such
|
|
|
|
writ, or in such action may, at any time before judg-
|
|
|

ment, direct the writ or any of the proceedings to
|
|
|
true name
|
be amended by inserting therein the true name of
|
|
|
|
any plaintiff or defendant, at the discretion of the
|
|
|
