ranking line officer, until a brigadier-general shall be duly
commissioned and qualified, and the headquarters of the
brigade shall be in Baltimore. The naval brigade shall be
officered and organized as follows : There shall be one captain
who shall command the same; one commander to act as execu-
tive officer, who shall be next in rank and in succession to
command to the captain; the commander shall also command
the first battalion; one lieutenant-commander to act as navi-
gator and ordnance officer, and to command the second bat-
talion, who shall be third in rank and in succession to
command. To each division there shall be one lieutenant to
command the same, one lieutenant (junior grade) and one
ensign. The staff shall consist of a surgeon, paymaster, chief
engineer and chaplain, each with the rank of lieutenant; an
assistant surgeon, assistant paymaster and assistant engineer,
each with the rank of ensign, and one ensign to act as aide,
all of whom shall be appointed and commissioned by the
commander-in-chief on the nomination of the captain. The
commander-in-chief shall prescribe the number and rank of
all warrant and petty officers. Warrant officers and petty
officers not assigned to a division shall be appointed and
examined, and, if found qualified, warranted by the captain or
commanding officer; divisional petty officers shall be appointed
by the commanding officers of the respective divisions, who
shall certify the same to the captain or commanding officer;
the captain or commanding officer shall thereupon cause an
examination of the officers so appointed to be held, and if they
shall be qualified, he shall issue warrants accordingly. The
rank given in this article to officers of the naval brigade is
naval rank. The relative rank of officers in said brigade with
officers in the United States army is as follows: Captain,
with colonel; commander, with lieutenant-colonel; lieutenant-
commander, with major; lieutenant, with captain; lieutenant
(junior grade), with first lieutenant; and ensigns, with second
lieutenant. The relative position of seamen, ordinary seamen
and landsmen shall be that of a private in the United States
army, and the relative positions of petty officers in the said
naval brigade with non-commissioned officers in the United
States army shall be determined by the commander-in-chief.
