parties, the incorporation of any body corporate, and the repre-
sentative character of any party suing, or being sued, shall be
taken as admitted for the purpose of such action or proceeding,
unless the same shall be denied in writing by the opposite party
before the hearing of such case; and whenever such denial is so
made, the court or justice before whom the case is pending shall,
at the request of the party against whom such written denial is
made, postpone. or continue the same to such reasonable time as
will enable the party to procure the required proof.

2. He shall have power to appoint a chief clerk who shall
receive a salary of twelve hundred dollars per annum, and one
assistant clerk who shall receive one thousand dollars per annum,
and two assistant clerks who shall receive each a salary of nine
hundred dollars per annum; and the sum of four thousand dol-
lars, or so much thereof as may be necessary, is hereby appro-
priated annually for said purpose.

11. All moneys payable to the State on account of the public
lands and all fees shall be paid to the commissioner of the land
office, whose receipts therefor shall be a good acquittance to the
party paying the same; and the said commissioner shall keep an
accurate account of all such payments in a book kept for the
purpose, and shall account semi annually, on the thirty-first day
