956 CHARLES COUNTY. [ART. 9.

than twenty-five dollars or more than one hundred dollars, and be
imprisoned in the county jail not less than thirty days nor more
than ninety days, or both, in the discretion of the court before

which he shall be tried and convicted; the said fine to be applied
to the road fund of the county.

164. Any supervisor who shall fail or neglect to perform the

duties under section 162, shall be guilty of a misdemeanor, and be
liable to presentment and indictment by the grand jury, and on
conviction in a court of law, shall be fined not less than fifty

dollars nor more than one hundred dollars, in the discretion of the

court; said fine to be applied to said road fund.

160. The road running from Glymont, through Cornwallis'
neck, to the mouth of Mattawoman creek, in Charles county, and
the road leading from the public road from New Port to Budd's

creek, in Charles county, through the lands of John L. Budd to
the Wicomico river, are excepted from the provisions of section
162.

SCHOOLS.

1886, ch. 303.

166. The governor, by and with the advice and consent of the
senate, shall, at every regular session of the general assembly,
appoint three persons in each of the following counties, namely:
Charles, Caroline, Prince George's, and Montgomery counties,
who shall constitute a board of school commissioners for their
respective counties.

167. The term of office of the boards of county school com-
missioners created by the preceding section shall be for two years
from the first day of May in every second year, accounting from
the year eighteen hundred and eighty-six, and until their suc-
cessors in office shall have been appointed and shall qualify.

168. The board of school commissioners of Charles county
are authorized, in their discretion, on and after the first day of
