906 CECIL COUNTY. [ART. 8.

1872, ch. 54.

403. The commander of the State police force shall have and
is hereby invested with concurrent jurisdiction and authority with,
the board of special police appointed by section 398, to arrest
without warrant for any violation of any of the provisions of
sections 380 to 402, inclusive.

1888, ch. 390.

404. No person shall at any time take, catch or trap, or at-
tempt to take, catch or trap, wild water-fowl, by nets of any
kind, within the Chesapeake bay or any of its tributaries within
Cecil, Harford or Baltimore counties, or within any of the waters
of said bay lying northward of a line drawn westerly from the
most southerly point of Cecil county bordering on said bay, to
the most southerly point of Baltimore county bordering on said
bay.

405. Any person violating any of the provisions of section
404, upon conviction thereof before any justice of the peace of
the county where such violation took place, or on indictment
before the circuit court for said county, shall pay a fine of not less
than fifty nor more than two hundred dollars, in the discretion of
said justice or court, and in default of payment of such fine shall
be forthwith committed to the county jail for the period of sixty
days; and from the judgment of said justice there shall be the
right of appeal to the circuit court for the county where said jus-
tice resides; provided, said appeal shall be taken within ten days

from the date of the rendition thereof; but execution thereon
shall not be stayed unless the party appealing shall give the usual
appeal bond to the State of Maryland in double the fine imposed,
and costs, with two sureties, to be approved by said justice.

406. The justices of the peace of Cecil, Harford and Balti-
more counties, and the circuit courts for each of said counties,
shall have concurrent jurisdiction in all cases that may arise under
the provisions of the preceding section when the violation of
such provisions takes place on said bay; and when such viola-
tion takes place on any waters or streams forming the boundary
