drain well covered and in good repair for the passage of vehicles
over the same; and all persons so offending shall upon conviction
be fined not less than'ten nor more than one hundred dollars, said
fine to be paid into the county treasury to the credit of the road
and bridge account; and when any unlawful obstruction or injury
to a public road shall be reported to the road commissioner, in.
whose road district the same is located, he shall forthwith remove
said obstruction, or repair said injury, at the cost of the person
causing the same; and if such person shall refuse to pay the cost to
the road commissioner, the county commissioners shall pay the
same and institute suit at once against him to recover said
costs.

321. Whenever any doubt may exist as to the proper location
or width of any road, the county commissioners may cause the
same to be surveyed, and in their discretion make such alterations
as the convenience of the public may require, and may compen-
sate any owner of land along said road who may be entitled to
compensation in consequence of said alterations.

322. The school commissioners shall not expend for school
purposes or for any other purpose, a greater sum of money in any
one year than shall be annually levied for school purposes by the
connty commissioners, in addition to the amount annually received
by said school commissioners from the treasurer of the State, and
they shall not borrow any sum of money in any one year which,
added to the actual receipts for such year would exceed their
yearly income as provided for by law; and it shall be lawful for
the holders of any indebtedness or any evidence of indebtedness
contracted in violation of this section, to sue upon or enforce the
same in any court of law or equity in this State, against said
school commissioners, either individually or collectively,

323. In case of the destruction of any school house by fire or
otherwise, the school commissioners, with the concurrence of the
county commissioners, may borrow so much money as may replace
