by the mayor and common council, who shall, within twenty
days after notification of their appointment, take an oath before
a justice of the peace of Carroll county, that they will faithfully,
fairly and withoiit partiality or prejudice, value and assess the
loss or damage to be suffered or incurred by any person interested
in the property over and through which said street, lane or alley
is to be opened, closed, extended, widened or improved, and also
to estimate the benefits that may accrue therefrom to any ad-
jacent property; and they shall, within ten days after such valua-
tion or assessment, return the same, in writing, under their hands
and seals, with a certificate of their qualification before a justice
of the peace, as hereinbefore provided, to the mayor and common
council of the town, which said valuation and assessment shall be
ratified or rejected by the mayor and common council, as in their
judgment may seem proper; and before actually opening, closing,
widening, extending or altering any street, lane or alley, the-
mayor and common council shall pay or tender, or cause to be
paid or tendered to the person, his agent, guardian or represen-
tative, the amount of damages so awarded; and if any person
shall feel aggrieved by the determination of the mayor and
common council in ratifying or rejecting said return, or in the
amount of compensation awarded, or in any matter relating to-
the same, he may within sixty days from the date of said ratifica-
tion or rejection appeal to the circuit court for CarroB county,
and the judgment of said court shall be final; and it shall be the
duty of the mayor and common council to cause the papers con- .
nected therewith to "be delivered to the clerk of said court, on
petition in writing of any person feeling himself aggrieved;
and the persons appointed to assess the damages as aforesaid shall
be paid such compensation as the mayor and council shall deter-
mine.

188. All fines, penalties and forfeitures imposed by the laws
and ordinances of the mayor and common council shall be re-
covered before the mayor or any justice of the peace residing
within the corporate limits of the town, upon a warrant issued
against the offender and directed to the bailiff in the corporate
name of the town, (except that the bailiff shall not be required
to have a warrant to arrest when he sees an offence committed,)-
