736 CARROLL COUNTY, [ART. 7.

SHERIFF.

1865, ch. 112.

139. The sheriff of Can-oil county shall be entitled to such
sum of money per day for boarding each prisoner or person com-
mitted to or confined in the jail of said county as the county
commissioners shall determine, not to exceed seventy-five cents
per day for each prisoner or person.

SURVEYOR.

1886, ch. 283.

140. It shall be the duty of the county surveyor of Carroll
county to survey all public roads to be hereafter opened, altered
or changed, and to make a plat and certificate of survey for the
use of the examiners appointed by the county commissioners to
open, alter or change any such public road in said county; and
the county commissioners shall not, nor shall said examiners, ap-
point or direct any other surveyor than the said county surveyor
to make said survey and plat, unless the said county surveyor
shall, from sickness or any other cause, fail or refuse to make said
survey and plat within a reasonable time after being requested by
the commissioners or examiners to make said survey and plat; in
which event either the commissioners or examiners may appoint
some competent person to make said survey and plat.

141. The compensation of the county surveyor for said ser-
vices shall be four dollars a day for each and every day so engaged,
and three dollars additional for making a plat and report to the
examiners, the same to be paid by the county commissioners.

STATE'S ATTORNEY.

1878, ch. 433.

142. The State's attorney for Carroll county shall receive the
following fees, to be paid by the county commissioners: In cases
punishable by confinement in the penitentiary, where an indict-
ment is found, ten dollars; in all other criminal cases, where an
indictment is found, five dollars; said fees to be in addition to
the appearance fees now allowed by law.
