and for such purposes are empowered and directed to enter upon
any private grounds or premises as often as they may deem neces-
sary to examine into the condition thereof, and if not found in a
satisfactory condition to adopt such means as may be necessary to
remedy the same.

114. They shall have power to lay an equal tax on the prop-
erty within the limits of the town, to such amount as may be
deemed necessary for the purposes of the corporation; which tax
shall be collected and paid to them by a collector appointed by
them, who shall have the same power to distrain therefor as the
collector of county taxes; and the burgess and commissioners
shall fix the term of office, responsibility and compensation of
such collector.

115. No land within said corporation not fronting on any
street or road shall be subject to taxation, but all front lots in
said town fronting on any street shall be subject to assessment
and taxation.

1872, ch. 158.

116. All fines, penalties and forfeitures imposed by the ordi-
nances imposed by the burgess and commissioners of said town,
shall be recovered before the burgess or any justice of the peace
of Carroll county, upon a warrant issued to the bailiff or any
constable of said county; and the said bailiff or constable shall
serve it under the same penalties as in cases of summons for small
debts from a justice of the peace, and receive the same fees, to be
paid by the corporation; and the person convicted, in default of
payment, may be committed to the jail of Carroll county, or an
appropriate place of confinement within the corporation, pro-
vided by the burgess and commissioners, for a period not exceed-
ing thirty days; but no fine or forfeiture shall, under any
ordinance of said corporation, exceed the sum of twenty dollars;
and the sheriff of said county shall receive and safe keep such
person, according to the tenor of the commitment, and shall be
entitled to his usual fees, to be paid by the corporation, if such
person so committed is unable to pay said fine, penalty, forfeiture
and costs.
