the evening; and the said judges and clerks shall receive the
same compensation as judges and clerks of election in Allegany
county, to be paid for by the said town.

1878, ch. 255.

137. In case of the death, refusal to act, resignation or dis-
qualification of any of the councilmen, it shall be the duty of the
mayor and councilmen, or remaining councilmen, to fill such
vacancy or vacancies, by joint ballot, at their next meeting, and
to certify to the clerk of the circuit court within ten days there-
after the name or names of the person or persons so appointed as
councilmen.

1870, ch. 77.

138. The mayor shall ex officio have all the powers of a jus-
tice of the peace in cases where the town is a party, and an appeal
may be taken from his judgment to the circuit court for Alle-
gany county, in the same manner as from a judgment of a justice
of the peace for said county.

139. The mayor and councilmen shall meet at the council
chamber on. the first Monday in May next succeeding their elec-
tion; and the said councilmen, before they enter upon the duties,
of their office, shall make oath before the mayor that they will
diligently and faithfully, to the best of their judgment, perform!
the duties of said councilmen of said town, without favor, par-
tiality or prejudice; the mayor shall take the oath prescribed by
the constitution before the clerk of the circuit court for Allegany
county, or before one of his sworn deputies.

140. They shall meet at the council chamber or some other
convenient place every month, at a stated time to be fixed by
ordinance, and the mayor or any three councilmen shall have
power to call special meetings at any time they may think neces-
sary; and the mayor shall preside at all meetings of the council,
and have the same power of voting and taking part in all acts
and deliberations of the council as any member thereof; and in
