2168 WORCESTER COUNTY. [ART. 24.

called Indian cockle, or any other poisonous weed or substance,
whether mixed with any other substance or not; every person so
offending shall be deemed guilty of a misdemeanor, and upon
conviction thereof, before any justice of the peace, in the name
of the State, shall be punished by a fine, in the discretion of the
justice, of not less than five nor more than twenty-five dollars, to
be collected by any constable in the district where such offence
may have been committed, in the same manner as other small
debts are collected; one-half of said fine shall be paid to the in-
former, and the other half into the public school fund of Wor-
cester county; but nothing herein contained shall be intended to
apply to any of the waters of said river below a point called and
known by the name of Porter's bridge.

217. Any person deeming himself aggrieved by any judgment
of a justice of the peace under the preceding sections, shall be
entitled to an appeal to the circuit court for the county, as in
other cases of appeal from judgments of justices of the peace.

218. It shall not be necessary to publish the public local laws
relating to Worcester county, in all the newspapers of said county.

RAILOAD CROSSINGS.

219. It shall be the duty of all railroad companies whose lines
pass through and are operated in Worcester county, to construct
and keep in good order cattle-guards wherever such railroads shall
pass through any enclosed lands, at the points where fences now
exist, or may hereafter become necessary upon such land, as may
be agreed upon between such railroad companies and the owner
of such land; provided, in case of any disagreement between said
parties, then such differences shall be ascertained and fixed by
three disinterested land owners, to be appointed by the circuit
court, upon the application of the land owner, after ten days'
notice to the railroad companies, whether they be dividing places
between contiguous farms or fences along the public highways,
