will diligently and faithfully, to the best of his skill and judg-
ment, perform the duties of a commissioner of said town without
favor, partiality or prejudice; and a certificate of such qualifi-
cation shall be made by the said justice of the peace and shall be
filed and recorded among the records of the proceedings of said
commissioners.

160. Said commissioners shall meet once in each month, except
during the months of June, July and August, when they shall
meet twice in each month, and more often if they think proper,
and a majority shall constitute a board for the transaction of busi-
ness; they shall, at their first meeting, or as soon thereafter as
possible, elect one of their number president, who shall preside
at the meetings of the board, give directions to the clerk and
bailiff, under instructions from the commissioners, and superin-
tend such improvements of the town as may be ordered by the
board.

161. They may appoint a clerk and prescribe his duties and
salary; the said clerk shall keep a book or record of the proceed-
ings and ordinances of said commissioners, which shall be open
at all times to the inspection of any person interested; and the
said clerk shall make out and furnish the collector, once in every
year, a list of taxes for collection.

162. They may pass ordinances to preserve the health of the
town; to prevent the erection of all privies, sinks or any place for
the deposit of refuse and unwholesome matter, without cement
cases for the contents of the same; to prevent and remove nuis-
ances; to prevent, restrain or regulate the running at large of
horses, cattle, swine and geese, within the limits of said town; to
prohibit the firing of guns and pistols, or the shooting of fire-
crackers within said town; to prohibit and disperse the tumultu-
ous meetings of idle, dissolute or drunken persons; to provide
for working and mending the public streets; for the paving of
the sidewalks and gutters, and generally for the regulation, good
government and improvement of said town; and they may en-
force the observance thereof under such penalties, fines and for-
feitures as they shall deem proper, not exceeding ten dollars for
