and close, straighten, improve, grade and pave streets; restrain
all disorders and disturbances; apprehend and fine all vagabonds,
and may impose fines, penalties and forfeitures for the violation
cf their ordinances.

44. They shall have full power to make such ordinances and
regulations as they may deem expedient for the comfort, health
and safety of said town, relating to the condition, location and
construction of all buildings, of whatever kind, whether erected
or proposed, and failure to comply with such ordinances and reg-
ulations within thirty days after being notified of the same in
writing, shall be punishable by a fine of not less than twenty dol-
lars nor more than one hundred dollars.

45. They may open, close, straighten or widen streets across
or through any yard, orchard or garden within the corporate
limits of the town.

46. Before they proceed to open, widen or straighten any
street, they shall appoint three disinterested citizens of said town,
owners of real estate therein, to be examiners, who shall give
notice of the time, place and purpose of their appointment, by
setting up a notice thereof, at three public places in said town, at
least ten days before the time of their meeting; and said exam-
iners shall lay off said street according to instructions given them
by the commissioners of Berlin, and shall value the damages done
to each owner of property injured by the opening, straightening
or widening of said street, and shall make to the said commis-
sioners a return in writing of their assessment of damages, with
a plat of the street as laid out by them.

47. The commissioners may ratify or reject the report of the
examiners making a return of the damages assessed by them.

48. Any person aggrieved by the amount of damages assessed
by said examiners, and ratified by said commissioners, may appeal
at any time within six months after said final ratification, to the
