may think proper. All ordinances passed by them shall be,
entered by said clerk in a book, which shall be kept by him for
that purpose, and which shall be open at all times for the inspec-
tion of any person interested, and copies of all ordinances shall
be put up in the most public places of said town.

36. All fines and forfeitures under the ordinances of said cor-
poration may be recovered before a justice of the peace by war-
rant, judgment and commitment to the public jail of said county,
in the same manner that commitments are made for fines imposed
by the circuit courts of this State on conviction for misdemeanor;
but the said commissioners shall have power at any time to remit
or release the said fines, penalties, forfeitures and costs, or any
part thereof, at their discretion; and any party who shall be
fined or subjected to any penalty or forfeiture, may, within five
days after the same shall be imposed and judgment recovered,
supersede or stay the same for thirty days by giving ample per-
sonal security to the justice of the peace; and the said fines,
penalties and forfeitures shall thereafter be collected as small
debts are now collected before a justice of the peace.

37. Said commissioners shall have full power to make all sucb
by-laws, regulations and ordinances, not inconsistent with the
constitution and laws of this State, as they may deem expedient
for the comfort, health, convenience and prosperity of said town
and its inhabitants; for the prevention and removal of nuisances
preservation of health, the restraint of disorder and disturbance;
and suppression of vice and immorality within the limits of said
town, and may enforce the observance thereof by such penalties
fines and forfeitures as they shall deem proper, not exceeding
five dollars for any one offence; and shall have power to lay an
equal tax on all the assessable property within said limits, except-
ing public and private securities and book accounts, to such an
amount as may from time to time be deemed necessary, not ex-
ceeding twenty cents on the one hundred dollars of assessable
property in any one year, which tax shall be collected and paid
to the president and commissioners by the collector appointed by
them, who shall have the same power to distrain therefor as the
