county, for the arrest of the offender, and to bring such offender
before said justice or any other justice of the peace of said
county; and upon conviction thereof the said offender shall be
fined not less than five or more than one hundred dollars, to-
gether with the costs of the proceedings, to be taxed as costs in
other criminal proceedings; one-half of said fine to be paid to
the informer, and the other half to the Washington county water
company; and in case of the non-payment of such fine and costs
imposed by said justice, the said offender shall be committed to
the county jail for a period not less than three days or more than
fifty days, or until such fine and costs are paid.

400. In addition to the remedy and punishment provided for
in the preceding section, the said water company is authorized
and empowered, by informations or petitions filed in its name, to
apply to the judge or to any judge of the circuit court for Wash-
ington county, in term time or vacation, for an injunction to
restrain and prevent the nuisances and evils intended to be pre-
vented by this sub-title of this article, no matter by whom or
under what authority committed.

401. It shall not be lawful for any person to shoot or kill, or
shoot at, any wild fowl in, on or over the waters of and in Wash-
ington county, in the night time, with gun of any size or descrip-
tion whatever.

402. Any person who shall violate the provisions of the pre-
ceding section shall be deemed guilty of a misdemeanor, and
upon conviction thereof before a justice of the peace of said
county, shall be sentenced to pay a fine of not less than five nor
more than fifty dollars, and upon failure to pay the same, shall
be committed to jail for not less than ten nor more than twenty
days; one-half of said fine to go to the informer and the other
half to the school fund of the county, subject to the right of
appeal and right of demand for jury trial as now allowed by law.
