than sixty days, and shall have his license suppressed, in the dis-
cretion of the court.

325. Any person under the age of twenty-one years, who-
obtains by misrepresentation or false statement as to his age, any
spirituous or fermented liquors from any person licensed to sell
such liquors under the provisions of sections 320 to 322, and any
person obtaining such liquors for a person under said age, by
misrepresentation or false statement as to his age, from any
person licensed as aforesaid, shall be deemed guilty of a misde-
meanor, and upon conviction thereof shall be fined not less than
five dollars, or confined in the county jail not less than thirty-
days, or both, in the discretion of the court.
LIVERY STABLES.
1876, ch. 157.
326. It shall be lawful for any livery stable keeper in Wash-
ington county to retain in his custody any horse, mare or gelding
placed under his care for livery, and also any vehicle, until all
charges for their .keeping shall have been paid by the owner.

327. It shall and may be lawful for such livery stable keeper
to sell any such horse, mare or gelding, or vehicle, at public
auction, for cash, in Hagerstown, in said county, after giving at
least three weeks' public notice of the time, place and terms of
sale, in one or more newspapers published in said county, prior to
the day of sale; and after deducting the amount due for such
keeping, together with all the expenses attending said sale, he
shall pay over the surplus, if any, to the owner of such horse,
mare or gelding, or vehicle.

328. Before proceeding as above, it shall be necessary for
such livery stable keeper to state an account for the keeping of
such horse, mare or gelding, or vehicle, and prove the same before
a justice of the peace for the county, who, upon being satisfied by
proof of demand, and refusal or neglect to pay on the part of the
owner of said property, shall thereupon issue his warrant author-
izing such sale as aforesaid; provided, that the proprietor of such
