and be sued, and may have and use a common seal.

73. The following shall be the bounds and limits of said town,
viz: beginning in the middle of the turnpike east of the town,
and at a point south nine degrees forty minutes, east thirty feet
distant from a stone on the north side of the turnpike, marked 82
M. to B., running first north nine degrees and forty minutes, west
sixty poles to a stone marked number two; second, south eighty
degrees twenty minutes west, parallel with the lower end of the
main street of Clearspring, two hundred poles to a stone marked
number three; thence third, south nine degrees forty minutes,
«ast one hundred and fifty poles to a stone marked number four;
thence fourth, north eighty degrees twenty minutes, east two
hundred poles to a stone marked number five; thence fifth, nine
degrees forty minutes, west ninety poles to the place of begin-
ning.

74. The male citizens of Clearspring qualified to vote for
members of the general assembly, shall elect by ballot on the first
Monday of January, annually, a burgess, assistant burgess and
five commissioners for said town, who shall be inhabitants thereof,
above the age of twenty-one years.

75. All elections shall be held and conducted in such manner
and at such place as shall from time to time be directed by the
by-laws of the corporation, not inconsistent with this charter.

76. If at any election, a choice of burgess, assistant burgess
and commissioners shall fail to be made by reason of a tie or
equality of votes, a second election shall be held after not less
than ten days' notice, and so on until such choice be made; and
the burgesses and commissioners for the time being shall continue
in office until their successors shall be duly elected.
