ART. 12.] OYSTERS—RIVERS. 1887

sale, with rakes or tongs, in the said Choptank river, shall first
obtain, by application to the clerk of the circuit court for said
counties, respectively, a license therefor; and such license shall
have effect from the first day of June in the year in which it may
be obtained to the first day of June succeeding, and shall author-
ize the use of said canoe or boat in taking or catching oysters on
either side of the dividing channel of said river, for sale to any
person; provided, that nothing herein contained shall be so con-
strued as to conflict with the rights of owners or occupants of
lands bordering on said river secured and protected under existing
laws.

164. For the purpose of more definitely defining the lines
for scraping oysters in the Choptank river, in Talbot county, the
following lines shall be construed as the mouths of tributaries, to
wit: Beginning at Jackson point at the north end of Tilghman
island, and running thence to Long or Nelson point, which line
shall be construed as defining the mouth of Harris' river; thence
from said Long or Nelson point to the south end of Royston's
island, and thence in a straight line to Benoine's point, which line
shall be construed as the mouth of Broad river and Irish creek.

165. It shall be unlawful for any person to use or employ
any boat or canoe licensed to take oysters with rakes and tongs,
in the waters of Talbot, Queen Anne's, Anne Arundel and Dor-
chester counties, in taking or catching oysters with any imple-
ments or device other than ordinary rakes or tongs with wooden
shafts, to be used entirely by hand, and without any ropes or
hoisting gear whatever. Any person violating the provisions of
this section shall be liable to the penalties prescribed in the public
general laws, article 72, title "Oysters," section 18, for taking
oysters with rakes or tongs without license.
