he will diligently and faithfully, according to the best of his
judgment, perform the duties of commissioner of said town, with-
out favor, partiality or prejudice; and a certificate of such quali-
fication shall be filed and recorded among their proceedings.

1884, ch. 88.

137. If any of the said three commissioners, during the term
for which he was elected, shall die, resign, remove from said
county, or be otherwise disqualified, an election shall be held to
fill the vacancy; or if, from any cause, the citizens of said town
shall neglect or fail to hold an election for commissioners, as
required by this sub-title of this article, then the commissioners in
office shall order an election within thirty days from such neglect
or failure to hold, and shall give ten days' notice of the time and
place of holding such election; and the president and commis-
sioners for the time being shall remain in office until such election
shall be held.

138. The said commissioners shall have power to meet and
adjourn from time to time as they shall think proper, and at their
first meeting after an election for commissioner shall choose from
their own body a president, who shall preside at all their meetings,
vote on all questions before them, and remain in office until
superseded by the appointment of a new president; after a new
election of a commissioner, they may also choose from their own
body, annually, a treasurer, and require him to give bond in such
penalty as they may prescribe; they may also appoint from their
own number, (or other persons,) three judges and one clerk of
election, and administer to them the necessary oaths.

139. They may appoint a clerk and prescribe his duties, and
allow him such compensation as they may think proper; and all
ordinances passed by them shall be entered by the clerk in a book
to be kept by him for that purpose, which shall be open at all
times for the inspection of any person interested, and copies of
all ordinances shall be set up in the most public places in said
town.
