1820 SOMERSET COUNTY. [ART. 20.

drag or dredge, or any similar instrument, in the waters of the
Great Annamessex river, in said county and State, east of a

straight line from Tenth's Point on the south side of said river,
to Porpoise Point on the north side of said river; but nothing
herein contained shall be construed to prohibit the catching of
crabs.

192. Any person violating any of the provisions of the pre-
ceding section shall be fined in a sum not less than fifty nor more
than one hundred dollars for each and every offence, and shall
stand committed to the county jail until such fine and'costs shall
be fully paid and satisfied.

193. On information under oath, of any violation of the pro-
visions of section 191, to any justice of the peace for Somerset
county, the said justice shall forthwith issue his warrant to
the sheriff or any constable of the said county, requiring the
officer to whom the said writ shall be directed to summon a
posse comitatus, if necessary, and proceed at once to arrest the
party alleged to have been engaged in violating any of the pro-
visions of said section, and forthwith bring the offender before
some justice of the peace for Somerset county for a hearing, and
unless the party accused, orthe State's attorney, shall claim a jury
trial, it shall be the duty of the said justice of the peace to give
the case an immediate hearing, or at the instance of the party
charged with a violation of said section, shall appoint some early

day within the next seven days thereafter, to hear the case, the
party charged giving such good and sufficient bail as said justice

shall require for his appearance at the trial; and on conviction of
the offender, the said justice shall fine said person in a sum not less
than fifty nor more than one hundred dollars, and costs in each
and every case, and shall have power to commit to the jail of
said county such offender so convicted, until such fine so imposed,
and costs, shall be fully paid and satisfied, subject to an appeal
in all cases to the circuit court for Somerset county, from any
judgment or conviction which may be rendered by said justice

of the peace.
