same; but the owner, master or any one having a mortgage or lien
on the said vessel, may appeal from the judgment of said justice
of the peace to the circuit court for Somerset county, and upon
giving bond in such sum as may represent double the value of the
said vessel, the said vessel shall be released; and it shall be the
dnty of the officers of the State fishery force to arrest all per-
sons found violating any of the provisions of said sections, and
bring the offender before some justice of the peace, most con-
venient, to be dealt with as herein provided; and the same
officers shall serve any warrant issued by any justice of the
peace of Somerset county, for the violation of said sections,
and immediately bring the offender before said justice of the
peace for trial. The money received from license for all'vessels
shall be paid by the clerk to the secretary and treasurer of the
school board for said county, for the use of the schools of Somer-
set county; and all fines shall be paid to the clerk of the court
of said county, by the justice of the peace hearing the case, with-
in thirty days from the date of the trial; and the said clerk shall
pay the same to the secretary and treasurer of the school board
of said county for the benefit of the school fund.

175. In all cases where a vessel or individual shall be tried,
either upon appeal or otherwise, for a violation of the provisions
of this sub-title of this article, and shall be acquitted or discharged
by the circuit court or by a justice of the peace for Somerset
county, the county commissioners shall pay the legal costs of
defending the prosecution, to such individual or the owner of
each vessel.

176. Any justice of the peace of said county, upon the oath
of any credible witness, may issue a warrant to the sheriff of said
county, or constable in said county, or to the commander of any
steamer or vessel of the oyster police force in said county, for the
arrest of any person, or the seizure of any vessel charged with the
violation of any of the provisions of sections 171 and 172; and
any of said officers shall have power to employ such force as
may be necessary to make such arrest or seizure.
