months a resident of the county, and that the license is intended
for his use only.

174. Any person violating any of the provisions of sections
171 and 172 shall be fined a sum not less than twenty-five dollars
nor more than one hundred dollars for each and every offence,
.and shall stand committed till fine and cost are paid; and on in-
formation, under oath, of any violation of any of the provisions-
of said sections, to any justice of the peace of said county,
he shall issue his warrant to the sheriff or constable of said
county, requiring either of them to summon a posse comitatus,
if necessary, and proceed at once to arrest the party alleged to
have been engaged in violation of said sections, and forth-
with bring the offender before some justice of the peace in and
for Somerset county for a hearing, and the said justice shall either
give the case an immediate hearing, or he shall, at the instance
of the party charged, appoint some day within the next seven
days thereafter to hear the case, first requiring the defendant to
give good and sufficient bail for the appearance of the defendant,
and the production of the vessel, if any shall be taken, at the
trial ; and if the defendant shall be found guilty of violating any
of the provisions of said sections within the waters of Somerset
county, the said justice shall fine such person not less than
twenty-five dollars nor more than one hundred dollars, to stand
committed till fine and costs are paid; but in all cases arising
under said sections, the defendant shall have the right of appeal
to the circuit court for Somerset county, from the judgment of
the justice of the peace; and the canoe, boat or other vessel
so unlawfully used shall be bound for the fine and costs, in all
cases where the master, owner or other person employing the said
vessel in violation of said sections shall not be arrested, and shall
neglect or wilfully fail or refuse to appear, then the justice of the
peace may proceed to hear the said charge, so far as it applies to
the said vessel, without such appearance; and if the charge appear
to be true the vessel shall be declared forfeited, but shall be re-
leased upon the payment of not less than twenty-five dollars nor
more than one hundred dollars, in the discretion of the justice of
the peace hearing the case, together with the costs attending the
