ten nor more than twenty dollars, to be imposed, upon conviction
thereof before a justice of the peace of the county, one-half to
the informer and the other half for the use of the school fund of
the county.

171. It shall be lawful for the citizens of Somerset county to
catch or take oysters with a scoop, drag or dredge, upon obtaining
a license therefor, as hereinafter directed, in any of the waters of
said county not parcel of any creek, cove, river or inlet; and no
person shall catch or take oysters in any of the waters of said
county without first having obtained a license therefor, as herein-
after provided.

172. The clerk of the circuit court for Somerset county, upon
the application of any person who has been a resident of said
county for six months, and of this State for twelve months
immediately preceding his application, and a bona fide owner of
the vessel, or upon the certificate of any justice of the peace of
said county certifying to the same, shall issue a license to such
citizen, authorizing him to catch or take oysters with scoop, drag
or dredge within said county, not parcel of any creek, cove, river
or inlet, which license shall hold good for one season only, and
shall only authorize the catching of oysters between the first day
of October in any year and the first day of April next succeeding,
on which last-mentioned day the dredging season shall close and
end in said county and said license shall expire, which said
license shall specify the kind of vessel to be used, the number
and name, if any, of the canoe or other vessel on which the said
license is to be used, and he shall pay for said scraping or dredg-
ing license at the rate of one dollar per ton for the vessel to be
so employed; and the tonnage of vessels under five tons shall be
ascertained in such manner as may be prescribed by said clerk of
the circuit court for said county, but no vessel above ten tons
burthen shall be licensed or employed in taking oysters with
scoop, drag or dredge within the waters of Somerset county,
unless at the time of applying to the clerk for license as
aforesaid, the owner thereof shall produce to the clerk a State
license in force authorizing said owner to employ the said vessel
in taking oysters in the waters of this State, in which case it shall
