1744 ST. MARY'S COUNTY. [ART. 19.

1872, ch. 404.

48. It shall and may be lawful for any citizen, having know-
ledge of the violation of the provisions of said sections, to arrest;
any person so as aforesaid violating the same, and to bring such
offender before any justice of the peace, to be dealt with accord-
ing to the provisions of this sub-title of this article.

49. If upon the hearing in any case of seizure as aforesaid, the
justice of the peace is satisfied that the owner or person having-
charge of the property so seized, is guilty of violating any of the
provisions of sections 44 or 45, then such justice shall adjudge
the same to be condemned and sold by the sheriff or any constable,
after ten days' public notice; and the justice may proceed exparte
to hear and determine any question of forfeiture, if the owner
fails to appear after the notice herein required to be given; and
in all cases arising under said sections 44 or 45, an appeal may be
taken to the circuit court for St. Mary's county, subject to the
same laws and rules that govern in other cases of appeal from the
decisions of justices of the peace.

50. The sheriff, constable or other party making such seizure
of property, if he does not know the name of the owner, or the
person having charge thereof, may describe him in said notice as
the owner of the property, without naming him; and the justice,
if he does not know the name of the owner, may condemn the
property as the property of a person guilty of violating the law,
without naming such person.

51. The proceeds of the sale of any property forfeited as afore-
said, with all fines imposed and collected under section 46, shall,
after paying the expenses of the seizure, condemnation and sale,
be divided, one-fourth to the sheriff or any constable making the
seizure, one-fourth to those aiding in making the arrest and seiz-
ure, and the remaining one-half to the board of school commis-
sioners for St. Mary's county, for the use of the public schools.
