BIRDS AND CAME.

25. It shall be unlawful for any person, at any time, to shoot,
trap or otherwise kill or injure, or pursue with such intent, any
of the following named birds, within the limits of Queen Anne's
county, viz: mocking-bird, blue-bird, oriole, thrush, swallow,
martin, lark, red-bird, cat-bird, wren, sparrow, whippoorwill,
pewit, goldfinch, sapsucker, hanging-bird, jay-bird or woodpecker.
Robins may be shot from and after the first day of October until
the first day of March in each year; and it shall be unlawful for
any person knowingly and unnecessarily to destroy or disturb the
eggs or nests of any of the above named birds.

26. The possession at any time by any person within the
county, of any of the said birds, except robins, shot, killed or in
anywise destroyed, and the possession by any person within the
county, of any robin, between the first day of March and the
first day of October, and the possession at any time of any egga
of any of said birds, shall be prima, fade evidence of a viola-
tion of the preceding section.

27. Any person violating section 25, upon conviction thereof
before any justice of the peace of said county, shall forfeit
and pay to the said justice of the peace, the sum of two dol-
lars for every bird so killed or destroyed, and for every nest so
disturbed, robbed or broken up, together with costs of prosecu-
tion; and one-half of said forfeit or fine shall be paid to the
informer, and the other half to the treasurer of the county school
commissioners, for the use of the public schools of the county;
and if any offender, after conviction under said section, shall
refuse to pay the fine herein imposed, he shall be committed to
the county jail, for each and every such offence, for not less than
five nor more than ten days, in the discretion of the justice so
committing; provided, however, that such conviction shall be
within sixty days after the offence.
