section shall prove to the satisfaction of any justice of the peace-
residing in said village, that the said swine did not go at large-
from negligence or want of care on his part, and that due dili-
gence was used to prevent it, he shall have return of the property
on paying all expenses of keeping and proving the same, and
fifty cents for taking up each one of such swine.

56. The public ground and property within said corporation,
belonging to the village, shall be vested in the commissioners, so
far as to preserve the same, to prevent depredations thereon, and
to have and to hold for the benefit of said corporation.

57. The commissioners of said village are authorized to pass
ordinances for the regulation, good government, improvement
and comfort of the said corporation, and the inhabitants thereof;
to suppress vice, crime and immorality; to restrain disorder and
disturbances of the peace; and to prevent and remove nuisances-
within said corporation.

58. They are authorized and empowered to enforce all ordi-
nances passed by them, and to affix penalties, fines and forfeitures-
for a breach of the same; provided, that such fines, penalties and
forfeitures shall not exceed the sum of ten dollars for any one-
offence, and the term of imprisonment for any one offence shall
not exceed five days.

59. They are authorized to levy a reasonable tax on dogs and!
bitches belonging to or kept by the inhabitants of the village, to
be recovered and collected as other taxes are, and to impose
reasonable fines and penalties to restrain dogs and bitches from
running at large in the village, and to authorize and compel
the bailiff to kill any dog or bitch whose owner cannot be ascer-
tained, or who shall refuse or neglect to pay the taxes, fines or
penalties imposed under this section.
