aid the said trustees, and the officers appointed by them, in the

discharge of their respective duties.

23. If any person shall be sued or prosecuted for anything

done in pursuance of this sub-title of this article, or anything
therein contained, he may plead the general issue and give the
special matter in evidence; and if upon trial a verdict shall be
found for defendant, or the plaintiff be non-suited or discontinue,
the defendant shall recover treble costs, and if the plaintiff shall
be unable to pay them, they shall be paid by the attorney who
brought or prosecuted the suit, unless the plaintiff shall give

security for them, to be approved by the court.

BAILIFFS.

P. L. L., (1860,) art. 16, sec. 25.

24. The county commissioners shall annually levy a sum of
money sufficient to pay the bailiffs, and a certificate signed by the

clerk of the circuit court, and expressing the number of days any
bailiff shall have served and the sum due for such services, shall
be sufficient authority to them to pay the amount therein speci-
fied; and the balance, if any, remaining at the end of the year
shall be applied by them to the use of the county.

BIRDS AND CAME.

1872, ch. 881.

25. It shall be unlawful for any person, at any time, to shoot

or trap, or otherwise kill or injure, or pursue with such intent,
any of the following named birds, within the limits of Prince
George's county, viz: blue bird, thrush, martin, mocking bird,
swallow, lark, oriole, red bird, cat bird, sparrow, whippoor-

will, wren, pewit, goldfinch, sapsucker, hanging bird and wood-
pecker; but nothing contained in this section shall be so con-
strued as to prevent the killing or capture of crows, blackbirds,
hawks, owls or other kinds of birds of prey; but the bird known

as the English mocking-bird shall not, under any circumstances,
be shot, entrapped or caged.
