ship the same beyond the limits of said county, for one year from
the day on which said license is issued; and the person named
therein or a party procuring such license shall pay to said clerk
for such license the sum of one hundred dollars, and fifty cents to
the clerk for his fee for issuing such license; any person violating
the provisions of this section by selling or shipping game for sale,
shall be fined the sum of five dollars for every partridge, wood-
cock or rabbit sold or shipped.

39. The possession by any person within the county, of any of
the birds or rabbits mentioned in the preceding section, at any
time in which the shooting or trapping of the same is prohibited
by said preceding section, or the possession by any express or
transportation company, of any partridge, woodcock or rabbits, at
any time, shall be prima facie evidence of violation of said sec-
tions.

40. Any person found trespassing upon any private property
in the county, which shall have been posted or advertised, shall
be liable to be arrested by any constable of the county, and shall
be deemed guilty of a misdemeanor, and on conviction thereof
before any justice of the peace of the said county, shall be fined
the sum of five dollars; and on failure to pay said fine shall be
confined in the county jail for a term of ten days.

41. It shall be the duty of the constables of the several elec-
tion districts of the county to arrest any person violating any of
the provisions of the preceding section and take them before the
nearest justice of the peace, to be dealt with as therein directed.

42. The fines collected by any justice of the peace of said
county, under the provisions of the seven preceding sections, and
the money paid to said clerk of the circuit court for license under
the provisions of sections 37 and 38, shall be paid by the said
justice of the peace and clerk, to the county commissioners, to be
by them placed to the credit of the school fund of said county.
