between the first day of January and the tenth day of June in
either of said counties; nor any rail birds, reed birds or pheasants
between the first day of February and the fifth day of Septem-
ber in each year in Cecil county; nor any rail birds or pheasants
between the first day of February and the first day of September
in each year in Harford county; and the possession of any of the
birds or game mentioned in this section during the prohibited
periods shall be deemed prima facie evidence against such per-
sons of a violation of this section, except when it may appear
that such birds or game are for breeding purposes.

43. Any person violating the provisions of the preceding sec-
tion, on conviction thereof before any justice of the peace of
said county, shall pay a fine of five dollars for each partridge,
rabbit, woodcock, rail bird or pheasant, shot or taken, or exposed
for sale; and on failure to pay said fine shall be lodged in the
county jail for a term of not less than ten nor more than thirty
days.

44. Any person found trespassing with dog or gan upon any
private property in said county, shall be liable to be arrested by
any constable of said county, and on conviction thereof before
any justice of the peace of said county, shall pay a fine of five
dollars; and on failure to pay said fine, shall be confined in the
jail of said county for a term of not less than five nor more than
ten days.

45. Any party against whom any justice of the peace shall
render a judgment under the provisions of the three preceding
sections, may at any time within twenty days from the rendition
thereof, appeal from such judgment to the circuit court for the
county.

46. The fines which may be collected under the provisions of
sections 42, 43 and 44, shall be paid by the justices of the peace
to the county commissioners, to be by them placed to the credit
of the school fund of the county.
