1312 HARFORD COUNTY. [ART. 13.

the following named birds, within the limits of Harford county,
viz: blue bird, thrush, martin, mocking bird, swallow, oriole,
red bird, catbird, sparrow, whippoorwill, wren, pewit, goldfinch,
sapsucker, hanging bird or woodpecker.

39. It shall be unlawful for any person knowingly and
unnecessarily to destroy or disturb the eggs of any of the birds,
protected by the provisions of the preceding section.

40. Any person violating any of the provisions of the two
preceding sections, shall, on conviction thereof, be fined in any
sum not less than two dollars and not more than ten dollars for
each offence, with costs of prosecution; and all prosecutions,
under said sections shall be in the name of the State, before any
justice of the peace of the election district in which such viola-
tions may occur; and of all such fines collected, one-half shall be
paid to the informer and the other half to the school commission-
ers of the county, to be applied by them to the support of the-
public schools of said county.

41. The possession by any person within said county, of any
of the birds protected by the three preceding sections, shot,
killed or otherwise destroyed, shall be prima facie and sufficient
evidence to make such person liable for the fine for the viola-
tion of the provisions of said sections; and it shall be the duty of
all constables of said county to arrest all persons they may detect
in or who may be charged with the violation of any of said pro-
visions, and take them before the nearest justice of the peace, to
be dealt with as directed by the preceding section.

42. It shall not be lawful to shoot, trap or kill, or in any man-
ner destroy or expose for sale any partridge or rabbit in Cecil
county between the tenth day of January and the first day of
November, and in Harford county between the twenty-sixth day
of December and the fifteenth day of October; nor any woodcock
