shall be imprisoned in the county jail not less than twenty days
or more than thirty days for the first offence; and not less than
thirty days or more than sixty days for the second offence; and
not less than sixty days or more than ninety days for the third
offence; and for each and every succeeding offence the same as
the third offence.

374. All fish dams or other devices for catching fish, and all
other erections in the Monocacy river below Kemp's, lately
Davis' mill dam, are nuisances, and may be pulled down and
abated as such by any person, and the person erecting the same
shall be liable to indictment, as in other cases of nuisance.

375. If any person shall obstruct or hinder any other person
from abating such nuisance, or shall assault or wound any person
for abating the same, after attempting so to do, he shall, besides
being subject to an action by the party injured, forfeit the sum
of one hundred dollars, to be recovered by action of debt in the
circuit court for said county, or by indictment in said court, one-
half to the informer or to him who will stie for or prosecute the
same with effect, and the other half to the use of the county.

376. The citizens of the town of New Market, in Frederick
county, are a body corporate by the name of "The Commissioners
of the town of New Market," and by that name may have per-
petual succession, sue and be sued, and may have and use a com-
mon seal, which they may alter at pleasure.
