1190 FREDERICK COUNTY. [ART. 11.

F. L. L., (1860,) art. 11, sec. 231.

369. The burgess may commit any vagabond, who may be
found wandering about the streets of said town, to the almshouse
of the county.

370. Any person may take up and impound any geese or
ewine found going at large in Middletown, and the person so
taking up the same shall give four days' notice by advertisements
set up at four of the most public places in said town, describing
the swine or geese so taken up, and that the same will be sold
in the most public square in the town, at public sale, for cash;.
one-half of the purchase money shall go to the owner and the
other half to the person taking them up; and if no owner shall
claim the said half on the day of sale, the same shall be paid to
the trustees of the Middletown school, to be appropriated to the
use of the school, unless demanded by the owner within one
month.

371. If the owner of the geese or swine so impounded can
prove to the satisfaction of any justice of the peace in said town
that the geese or swine did not go at large from negligence or
want of care on his part, and that due diligence was used to pre-
vent it, the said owner shall have return of the said property on
paying the expenses of keeping and impounding the same.

372. If any person shall trespass upon the lands of any other
person or body corporate, that are used for agricultural, gar-
dening or fruit growing purposes in Middletown election dis-
trict, Frederick county, upon conviction thereof before any
justice of the peace in said county, he shall be adjudged guilty
of misdemeanor, and shall be fined not less than two dollars and
fifty cents, nor more than five dollars for the first offence; and not
less than five dollars nor more than ten dollars for the second
offence; and not less than ten dollars or more than twenty dollars
for the third offence; and for each and every succeeding offence
the same as the third offence; and in case the person so offending
shall neglect or refuse to pay the said fines so imposed, then he.
