debt, in the name of the corporation, before the burgess or any
justice of the peace of Frederick county, upon warrant against
the offender directed to any constable of the county or of said
corporation, in the same manner as small debts are recovered;
and the constable shall serve the same under the same penalties as
in cases of summons for small debts from a justice of the peace,
and shall receive the same fees therefor, to be paid by the cor-
poration.

132. An appeal shall lie to the circuit court for Frederick
county from any judgment of the burgess or any justice of the
peace imposing any fine, penalty or forfeiture under the ordinances
of the said corporation, subject to the same conditions and regu-
lations now provided by the general laws regulating appeals from
justices of the peace; but enforcement of said judgments shall
not be delayed, unless the party appealing shall give bond to the
corporation in double the amount of the judgment and costs, with
security approved by the burgess or justice of the peace rendering;
the judgment, with condition to prosecute the appeal with effect,
or to pay the judgment rendered, with costs.

133. The burgess or any justice of the peace when imposing
any fine, penalty or forfeiture, for the violation of any ordinance
of said corporation, shall order the person convicted to be com-
mitted to the public jail if he shall fail or refuse to pay the fine,
penalty or forfeiture and costs, there to remain until the same are
paid or until discharged according to law; and the sheriff of said
county shall receive and safe keep in the public jail all persons,
who shall be committed thereto for a breach of any of the laws or
ordinances of said corporation, according to the tenor of the com-
mitment, and in the same manner and under the same regulations
as persons committed for violations of the laws of this State.

134. The burgess shall have power to issue subpoenas for wit-
nesses, and may enforce their attendance by attachment; and the
burgess and any justice of the peace, and the constables and wit-
nesses, shall be severally entitled to the same fees and allowances
as in cases for the recovery of small debts.
