diseases, the powers of the corporation shall extend to the distance
of one mile from the town.

109. The male citizens of Emmitsburg, above twenty-one
years of age, who shall have resided in said town twelve months
next preceding the election, shall elect by ballot, on the first
Monday in May, annually, a burgess and six commissioners for
said town, each of whom shall have been an inhabitant thereof at
least twelve months next preceding the election, shall be.a citizen
of the United States, above twenty-five years of age, and shall
hold real property in said town.

110. All elections shall be held by one or more judges, in such
manner as shall from time to time be directed by ordinance of
the corporation, and the polls shall be kept open from nine o'clock
in the morning until two o'clock in the afternoon.

111. If the inhabitants of said town shall at any time neglect
to make an election at the time herein required, the power of
electing a burgess and commissioners shall not therefore cease,
but the power of said inhabitants in that respect shall continue,
and the burgess and commissioners for the time being shall con-
tinue in office until the said election shall be held, and their
successors qualify.

112. In case of the death, refusal to act, disqalification,
resignation or removal of the burgess or any of the commission-
ers, out of the limits of the corporation, the commissioners, or a
majority of them for the time being, shall elect a burgess or
commissioner to fill the vacancy for the remainder of the term
and until a successor shall be elected and qualified,
