1104 FREDERICK COUNTY. [ART. 11.

1884, ch. 209.

51. The carrying of pheasants, partridges, squirrels or wood-
cock from door to door shall be prima facie evidence that the
same were being offered for sale.

52. No person shall refuse to testify concerning any violations,
of the seven preceding sections, except when said person is on
trial at the time; and said testimony shall not be used subse-
quently against the party so testifying.

53. Any justice of the peace of Frederick county shall have
jurisdiction of any violations of said sections; and any person
offending against any of the provisions of said sections, and
being convicted thereof before a justice of the peace, shall
forfeit the fine named in section 48, the one-half of which shall
go to the informer, and the balance to the county commissioners;
and if the offender, on being convicted of a violation of any of
the provisions of said sections, shall fail to pay said fine and the.
costs, he shall be committed to the common jail of Frederick
county, for every such offence, for not less than thirty days nor
more than six months.

1888, ch. 252.

54. It shall not be lawful in Frederick county to shoot, kill, or
in any way entrap or destroy any wild turkeys except between
the fifteenth day of November and the fifteenth day of the fol-
lowing January. Any person violating any of the provisions of
this section shall be deemed guilty of a misdemeanor, and shall
be subject to a penalty of not less than five nor more than ten
dollars for each and every offence, and on conviction before a
justice of the peace in and for Frederick county shall be committed
to the county jail until such penalty shall be paid; but such im.
prisonment shall not exceed one day for each dollar of penalty
imposed.

55. It shall be unlawful for any person to snare or loop in any
way any pheasant or partridge in Frederick county at any season
