prisoners in the jail; and it shall likewise be his duty to keep a
correct and full schedule or statement of all persons committed
to the jail, showing the length of time for which they are com-
mitted, the offence for which they are committed, and the name
of the officer by whom committed, which schedule or statement
shall at all times be open to the inspection of the commissioners.
For any neglect by the sheriff to comply with any provision of
this section, he shall be liable to the fine prescribed in the pre-
ceding section.

37. It shall be the duty of the commissioners, should any
balance remain in their hands at the end of any year over and
above the expenditures for that year, to deduct such balance from,
the estimate for the succeeding year, and to make requisition on
the county commissioners only for the balance; and it shall like-
wise be their duty to keep the several accounts for the jail and
almshouse, separate and distinct, and to submit in their annual re-
port to the county commissioners separate statements respecting
the receipts and disbursements on account of the jail and the
almshouse.

38. The county commissioners shall annually levy upon the
assessable property of the county a sum sufficient to pay the
bailiffs of the circuit court, and provide for the payment of the
same at the end of each term of the court.

1872, ch 303.

39. It shall not be lawful for any person in Frederick county
to shoot, kill, or in any way trap or destroy any blue-bird, swallow,
martin, robin, cat-bird, woodpecker, sparrow, wren, whippoorwill,
dove, or any insectivorous birds, at any season of the year, under
the penalty of two dollars for each bird so killed, taken or
destroyed.
