taking and catching of the same, shall be deemed prima facie
evidence that said person has violated said section.

1878, ch. 434

296. The constables of the several counties of this State, upon
the information of any one, shall arrest all persons violating the
provisions of any of the six preceding sections, and carry them
before the nearest justice of the peace of the county wherein such
offences shall have been committed, to be dealt with in accordance
with the provisions of section 294.

1874, ch. 367.

297. Every person who shall, within the limits of Dorchester
county, enter upon the lands of another with gun or dog, and shoot
or kill any partridge, lark, dove or robin, or any insectivorous bird
of any kind whatsoever, or any rabbit or squirrel, shall be deemed
guilty of a misdemeanor, and shall be liable to presentment and
indictment therefor by the grand jury of said county, and upon
conviction thereof, shall be fined not less than five or more than
fifty dollars, or be imprisoned in the jail of said county not less
than one month or more than three months, or be both fined and
imprisoned as aforesaid, in the discretion of the court before which
said presentment or indictment shall be tried; provided, that the
owner or possessor of the land trespassed upon shall have fore-
warned all persons from hunting with, dog or gun thereupon, by
notice through some newspaper published in Dorchester county,
or by posters placed in at least five of the most conspicuous places
upon said land, and that the person presented or indicted shall
not have afterwards obtained the permission of said owner or
possessor so to hunt or gun.

VIENNA.

1874, ch. 440.

298. The citizens of the town of Vienna are a body corporate
by the name of the " Commissioners of the town of Vienna," and
by that name may have perpetual succession, sue and be sued,
and may have and use a common seal, which they may alter at
pleasure.
