1058 DORCHESTER COUNTY. [ART. 10.

1886, ch. 806.

256. The managing owner of such boat shall make oath or
affirmation before the clerk that he is the bona fide managing
owner of such boat described in the license; that he has been a
resident of said county for the time before mentioned; that the
boat is wholly owned by residents of said county; that there is no
lien, interest or claim on said boat held by a non-resident of Dor-
chester county; that the said boat is not held with an intention to
violate the provisions of sections 253 to 262, inclusive; that said
boat has been owned in whole by residents of said county the six
preceding months, if it is of six or more months old; and the
master of said boat shall also make oath before said clerk that he
has been a resident of said county for twelve months next pre-
ceding the time of taking such oath, and that he will comply with
ond obey all the laws of this State and county, regulating the
catching of oysters; and at the time of taking such oath or
affirmation he shall exhibit to the clerk the custom-house license
of said boat, if over five tons.

257. Any master or person in charge of any boat, canoe or
vessel, who shall take or catch oysters in the waters of said county
with scoops or dredges, without first having obtained license as
provided in the preceding sections, or any managing owner who
shall fraudulently obtain such license, shall be deemed guilty of a
misdemeanor, and upon conviction before a justice of the peace
or judge of the circuit court for said county, shall be fined not
less than one hundred dollars nor more than two hundred dollars,
and stand committed until fine and costs are paid, or be impris-
oned in the house of correction for a period of not less than three
months nor more than one year.

258. Any person who shall use any boat, canoe or vessel, to
catch oysters with scrapes or dredges in any of the waters of said
county not authorized by section 253, or refuses to exhibit the
custom house or dredging license whenever called for by any
officer of the State of Maryland, or for catching oysters before
the season commences, or after it has closed, or for any other
