1011 MILITIA—MARYLAND NATIONAL GUARD. [ART. 65.

the amounts by him disbursed to or for the said respective organ-
izations, whether out of the appropriation made by the general
assembly or out of the appropriation received from the United
States government; to which account all commissioned officers of
the Maryland national guard shall have access at all reasonable
times, and the adjutant general shall make annually to the com-
mander-in-chief, and to the general assembly at each session, a
detailed itemized report of all sums of money disbursed by him
to or for the said Maryland national guard, specifying separately
the amounts disbursed to each respective organization thereof,
and for what purpose; and he shall likewise publish annually for
the information of the public and of said Maryland national guard
the said reports so by him to be made.

43. The commander-in-chief or the brigade commander, at any
time in their discretion may require any officer of the Maryland
national guard to appear before a board of not less than three
officers, to stand an examination and inquiry as to his fitness for
the position he holds and as to his efficiency; and in case the said
board shall report such officer unfit or inefficient the commission
of such officer shall be vacated; provided, however, that if such
officer shall feel aggrieved by such adverse decision, he may de-
mand a court of inquiry or a general court martial, the decision
of which, when approved by the commander-in-chief shall be
final and binding; and provided further, that a majority of such
board of officers before whom any officer shall be examined as
aforesaid, shall be at least of equal rank with the officer so
examined.

44. The commander-in-chief may at any time order general
courts martial for the trial of any officer or enh'sted man of the
Maryland national guard for any military offences; and he may
also, by such general rules and regulations as he may think proper
to publish from time to time, provide for organizing and convening
brigade, regimental, battalion and company courts martial by the
respective commanders thereof, for the trial of all such military
offences; such rules and regulations, until changed, to be binding
upon the officers and soldiers of the Maryland national guard.
