1010 MILITIA—MARYLAND NATIONAL GUARD. [ART. 65.

said organization above designated, and enrolled, enlisted and
organized as above provided.

38. Whatever sum of money is now or may be hereafter
appropriated by the general assembly of Maryland, for the use
and benefit of said Maryland national guard, shall be distributed
under and by the direction of the governor, the commander-in-
chief, to each company of said Maryland national guard which
shall have complied with the requirements of law, in equal
proportion, without distinction; and it shall be the duty of the
commanding officer of each of said companies to receive the share
of said money to which his said company may be entitled, and to
make quarterly reports under oath to the said adjutant general,
setting forth the details of the disbursement of said money.

39. The commanding officer of each company shall give a
good and sufficient bond to the State of Maryland, to be approved
by the adjutant general, for the full and true performance of his
duties under section 38, as such disbursing officer.

40. If said disbursing officer shall fail to fully and properly
report to the adjutant general said quarterly payment to him by
the succeeding quarter day, then it shall be the duty of the gov-
ernor, the commander-in-chief, to direct the withholding of any
further payment of said money to said commanding officer until
said officer shall report as aforesaid to the adjutant general.

41. At any time, upon the report and recommendation of
the brigade commander, after an inspection by him ordered
or made of any company forming a part of said Maryland national
guard, that such company so inspected is not up to the proper
standard of efficiency or discipline, the commander-in-chief may,
in his discretion, muster ont of the service such company so re-
ported inefficient, and thereupon the commissions of all the officers
of such company shall be vacated.

42. The adjutant general shall keep a separate account with
each organization of the said Maryland national guard, showing
