ART. 65.] MILITIA—MARYLAND NATIONAL GUARD. 1005

(Baitimore); Talbot county guard, (Talbot county); the Allegany
county guard, (Cumberland); the Monumental city guard and the
Baltimore rifles, (Baltimore city); and three companies, one from;
Calvert county, one from Charles county, and one from Prince
George's county; the said Baltimore city companies other than ther
Fifth regiment and the said Monumental city guard and Balti-
more rifles, and the said county companies, other than the Alle-
gany county guard, may be formed into one or more battalions as
the commander-in-chief may deem best; and all said battalions,
may be formed into regiments if the commander-in-chief shall
consider the same advisable; the said brigade shall be com-
manded by a brigadier-general or the senior ranking officer, until
a brigadier-general shall be duly elected, when said election shall
be ordered by the commander-in-chief; and the head-quarters of
the brigade shall be in the city of Baltimore.

28. The men composing said force shall be sworn in as pre-
scribed in the general militia kw, and regularly enlisted; and
when so enlisted, shall be considered in the active militia service
of the State, and shall serve for the period of three years from,
the date of enlistment, unless sooner honorably discharged from,
service, or dishonorably dismissed therefrom for misconduct; all
officers and men belonging to said respective military organizations,
on April 1, 1886, shall constitute a portion of said force in all re-
spects as if duly enlisted at the time when they respectively became
members thereof; the period of their service to be accounted from,
the date when they so respectively became members; and so long
as they continue to be members thereof, they shall be subject to
all the rules of military discipline, and to the provisions of this
article; but it is expressly hereby provided, that no person then a
member, and who may then have already served for three years,
shall be compelled to re-enlist; any person then a member or
thereafter enlisting and becoming a member, who may already
have served or who may hereafter serve for a period of three
years, accounting from the date of his enlistment or becoming a
member, shall be entitled to a discharge at any time, upon appli-
cation to the commandant of the regiment or battalion or inde-
pendent company to which he belongs, if he has performed his
