PENITENTIARY.

 

1. The governor, by and with the advice and consent of the
Senate, shall biennially appoint directors of the Maryland Peniten-
tiary; he shall appoint during the present session of the General
Assembly six directors, two of whom shall be appointed for two
years, two shall be appointed for four years, and two shall be ap-
pointed for six years; and the governor shall designate the respec-
tive terms of said appointees; they shall hold office until their suc-
cessors are appointed and qualify, and may be removed as provided

for in this article. As the terms designated above shall expire, the
governor shall fill them for six years each.

2. Upon the happening of any vacancy in the said board of
directors, another person shall be appointed for the unexpired term
of the former incumbent.

3. The directors of the Maryland Penitentiary shall annually
appoint at their regular stated meeting in the month of May a
warden for the penitentiary, who shall serve for one year or until
the stated meeting of the board of directors, to be held in the month
of May of the year succeeding his election, or in the contingency of
the failure or omission of the board to make an appointment at the

time aforesaid to serve until his successor shall be chosen He may
be removed from office at any stated or special meeting of the board,
whenever in the judgment of the directors the public interest may
require such removal, and in the event of the office becoming vacant
by removal, death, or resignation, the directors aforesaid shall make
a new appointment for the unexpired term of the late incumbent.

4. The directors shall, before entering upon the duties of their
office, each take an oath that he will well and faithfully execute and
perform the duties appertaining to his office according to the laws
of this State, and the rules and regulations adopted for the govern-
ment of the Maryland Penitentiary, and that he will not during his
connection with said penitentiary, sell to or buy from the said insti-
tution or its authorities, directly or indirectly, any article or thing

whatever; and any director swearing falsely in the premises, and
being convicted thereof in due course of law, shall suffer as in cases
of wilful and corrupt perjury, and any director who shall act in his
office before taking said oath, shall, upon conviction thereof in the
Criminal Court of Baltimore, forfeit and pay the sum of two hun-
